2nd Annual OMSA Louisiana Tax Conference
The passage of HB 425 carries complex--but positive--implications for our industry. As such, the OMSA Louisiana Tax Conference seeks to address and educate its members and industry partners on these issues. In sum, HB 425 allows a vessel owner to contest ad valorem taxes assessed on vessels by paying the ad valorem taxes under protest while preserving the taxpayer's rights to the Louisiana state tax credits for ad valorem taxes, in short you can sue and still claim the credit. Under prior law, only ad valorem taxes paid without protest were eligible for the credit. The full text of HB 425 and amendments thereto can be found here and here.
